Maryland’s highest court is called the Court of Appeals, and it is comprised of seven judges. Currently there are four Republican judges and three Democratic judges. Maryland conducts retention elections, which means that the governor appoints a judge, who then must be retained or voted out by the voters at the end of the term. In 2020, three judges are up for retention.  This means that if a Justice receives a majority Yes vote in the election, s/he will serve for another term on the court before appearing on the ballot for another retention vote. If a Justice receives a majority No vote, s/he will be replaced by Republican Governor Larry Hogan.

Chief Judge Mary Ellen Barbera (D) was appointed to the court in 2008 by Democratic Governor Martin O’Malley. She was elevated the the position of Chief Judge in 2013.

Judge Brynja Booth (R) was appointed to the court in 2019 by Republican Governor Larry Hogan.
